The Village of Monticello has enacted a local law banning further landfill expansions within the village. However, the DEC permit proceeding will go forward despite this action. Sullivan County must obtain both local and DEC approvals before any construction can begin on the Phase II expansion. To obtain local approval the County must convince the village to change its policy.

The County enacted a Local Solid Waste Management Law in 1992 requiring recycling and "flow control," a policy requiring all waste generated in the county be managed at county-owned facilities such as transfer stations and landfills.

Administrative Law Judge (ALJ) Buhrmaster has issued several decisions on Phase I and Phase II. These can be found on DEC's website here. During the Phase II review proceeding the judge issued interim Rulings (July 29, 2005) and Rulings on Issues and Party Status (Jan. 18, 2007).

DEC Staff opposes permit issuance for Phase II, based on the inability of the project to comply within noise limits for landfills. The noise issue is one of dozens of issues Staff raised and the County resolved during the issues conference, as detailed in the following documents.
